TSCATest Introduction

The U.S. Toxic Substances Control Act, or TSCA (Toxic Substances Control Act), was enacted by the U.S. Congress in 1976 and is implemented by the U.S. Environmental Protection Agency (EPA). The bill aims to comprehensively consider the environmental, economic and social impacts of chemical substances circulating in the United States and prevent "unreasonable risks" to human health and the environment. After many revisions, TSCA has become an important regulation for the effective management of chemical substances in the United States and a prerequisite for normal trade of products exported to the United States. These rules came into effect on February 5, 2021, and will be implemented in phases from March 8.

TSCATest items

On January 6, 2021, the U.S. Environmental Protection Agency (EPA) issued a final rule in accordance with the requirements of Section 6(h) of the Toxic Substances Control Act (TSCA), which limits five chemicals with persistent, bioaccumulative, and toxic properties (PBT). It took effect on February 5, 2021, and will be phased in starting on March 8.

TSCADetection Range

TSCA applies to naturally occurring and chemically produced chemicals themselves, chemicals in mixtures, and chemicals intentionally released from articles. It should be noted that chemical substances defined by TSCA also include microorganisms. However, the following categories of chemicals are subject to other federal laws and are not regulated by TSCA: tobacco and tobacco products, nuclear materials, munitions, foods, food additives, drugs, cosmetics, and substances used solely as pesticides.

TSCATesting regulations management

The U.S. Toxic Substances Control Act (TSCA) does not classify substances into "toxic substances" and "non-toxic substances" as the name implies. Instead, it classifies substances into "existing substances" and "new substances" for management. Whether they are "new chemical substances" depends on whether the substance is included in the TSCA inventory. Substances such as food, pesticides, drugs, and tobacco are governed by other U.S. regulations and are exempt from TSCA declaration.
New substance management
For substances that are not included in the TSCA list, that is, new substances, if the exemption conditions are not met, the manufacturer or importer of the substance must make a PMN (pre-production) declaration.
Existing Substance Management
For substances listed on the TSCA list, that is, existing substances, the manufacturer or importer of the substance must confirm whether its substances and corresponding uses comply with the Significant New Use Rules (SNUR) and Chemical Data Reporting (CDR) requirements. Products that fall within the scope of TSCA supervision or exemption must provide a TSCA compliance or exemption statement when the product enters customs.
