The applicant, a wind power development company, and the respondent, an equipment manufacturing company, signed a "Wind Power Box Procurement Contract", agreeing to purchase 20 sets of offshore wind power boxes for 3MW units. Half a year after being put into operation, many wind power boxes experienced cracks in welds and corrosion of internal equipment, resulting in a loss of more than 10% of power generation. The development company believed that the box had quality defects and demanded compensation for losses. The manufacturing company argued that the problem was caused by improper installation, and both parties took it to court.

The main material of the wind power box involved is Q235B steel, with a yield strength of only 240MPa; the welding material is E4303 Welding rod, weld strength is insufficient. The unfused depth of the weld reaches 3mm (standard ≤1mm), and the surface porosity exceeds 2%; the thickness of the anti-corrosion coating is only 100μm (standard ≥150μm), and red rust appeared after 1,000 hours of salt spray testing.

The manufacturing company failed to provide the specified material box and welding materials in accordance with the contract. The process defects were significant, which constituted a fundamental breach of contract and was the main cause of equipment problems.
