quality product dispute situation:
According to the case data, the demander entrusted the supplier to replace and install the original landscape membrane. Less than half a year after the project was completed and the landscape membrane was put into use, the membrane tore and collapsed, injuring one person. However, there was no obvious damage to the steel wire rope and steel structure. The demander believed that the quality issues with the stretched film provided by the supplier caused the accident. The supplier believed that the collapse was caused by force majeure due to heavy snow load caused by consecutive days of heavy snow. In order to find out the facts, the purchaser applied for an appraisal to determine whether the cracking of the film in the "film drawing project" was a quality problem.
A The court entrusted our company to identify whether the cracking of the film in the "film drawing project" involved in the case was a quality problem.
quality analysis results:
The quality analysis expert group discussed and comprehensively analyzed the quality and technology of the membrane materials, on-site investigation and sampling testing involved in the "membrane project" involved, and made the following suggestions and conclusions:
1. On the one hand, the standard value of the ultimate tensile strength of the membrane material in the "membrane project" involved is significantly different from the design value of similar projects in the industry. There are design problems with improper selection of membrane materials or construction quality problems with the wrong membrane materials.
On the other hand, the "membrane pulling project" involved in the case had design or construction quality problems with insufficient pre-tension of the membrane material and steel cables, which resulted in excessive tensile deformation of the membrane material under the snow load, resulting in an excessive snow load in the area where the membrane was stretched. One of these two aspects, especially the former, or both together caused the tearing and collapse accident of the "membrane project" involved in the case in moderate snow weather;
2, the maximum snow load value in heavy snow weather at the time of the incident was less than the basic snow pressure value required by the local building structure load code where the incident occurred. Snow load was not the root cause of the tearing and collapse accident of the "membrane pulling project" involved.
